Introduction:
These terms and conditions (the "Terms") govern the use of the viaNotion software-as-a-service product (the "Service") owned and operated by viaNotion. By using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
Description of Service:
The Service enables users to manage and schedule content through Notion. viaNotion provides users with a platform to organize and streamline their content management process. The Service is provided "as is" and ViaNotion does not guarantee the accuracy, completeness or usefulness of the Service.
Account Creation and Security:
In order to use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. ViaNotion will not be liable for any loss or damage from your failure to comply with this security obligation.
Payment and Renewal:
The Service is offered on a subscription basis, with fees charged on a monthly or yearly basis. Your subscription will automatically renew unless you cancel it before the renewal date. You are responsible for paying all fees and taxes associated with the Service.
Refunds:
A free trial period is provided to test the ViaNotion service before subscribing. If after opting for the subscription, you are not satisfied with the Service, you may request a refund within one week of subscribing.
Refunds will be issued at the sole discretion of ViaNotion and only in exceptional circumstances, such as a material change to the Service or a technical issue that cannot be resolved.
By using the Service and subscribing, you agree to these refund policies and understand that refunds may not be granted in all circumstances.
Content
ViaNotion enables users to manage and schedule content through Notion. Please note that ViaNotion does not collect, store, or manage any content that users publish to social media platforms or other external sources.
The Service is designed to provide users with a platform to organize and streamline their content management process within their Notion workspace.
By using the Service, you acknowledge that all content remains under your sole control and responsibility and that ViaNotion is not liable for any misuse, loss or damage of such content. ViaNotion does not claim ownership or control over any content that you create, upload, post, or store using the Service.
You are solely responsible for the content that you post, upload, or otherwise make available through the Application. You will not post, upload or otherwise make available any content that:
- Infringes any copyright, trademark, trade secret, or other proprietary rights of any party
- Is defamatory, libelous, indecent, obscene, pornographic, sexually explicit, invasive of another's privacy, promotes violence, or contains hate speech
- Is false, misleading, or promotes illegal activities
- Contains viruses or any other computer code, files, or programs that interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment
Intellectual Property:
The Service, including all software, text, graphics, logos, images, and other content, is the property of ViaNotion and is protected by applicable intellectual property laws. You may not use the Service or its content in any way that infringes the rights of ViaNotion or any third party.
Termination:
Either party may terminate the Service at any time with or without cause. ViaNotion reserves the right to terminate your account if you violate these Terms or if you use the Service in a manner that is harmful to ViaNotion or its customers.
Disclaimer of Warranties:
The Service is provided "as is" without warranty of any kind. ViaNotion does not guarantee that the Service will meet your requirements or that it will be error-free. ViaNotion will not be liable for any damages arising from your use of the Service.
Limitation of Liability:
ViaNotion will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Service. The total liability of ViaNotion to you for all damages arising from your use of the Service is limited to the amount paid by you for the Service.
Changes to Terms:
ViaNotion reserves the right to modify these Terms at any time. Your continued use of the Service after any changes to these Terms will be deemed to be your acceptance of such changes.
Governing Law:
These Terms will be governed by the laws of India, without reference to its conflict of law principles.
Dispute Resolution:
Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act.
Entire Agreement:
These Terms constitute the entire agreement between you and ViaNotion and supersedes all prior or contemporaneous agreements or understandings, whether written or oral, relating to the Service.
